While Wagner obeyed Queen's orders to not harm the subject, the other, Orlando Block, disregarded the order, and tortured Lex. Wagner wisely chose not to intervene, knowing that Block would probably kill him too. Block also sent Wagner into LuthorCorp to locate the serum from floor 33.
When Lex used the serum to kill Block and start a fire, Wagner escaped the building, but not before witnessing someone put the fire out with super breath. He later reported what happened to Oliver Queen, who then tasked him with finding whoever extinguished the fire. He has not been seen since.
